Firmspace LP (“Firmspace”, “us,” “our,” or “we”) is committed to protecting your privacy. This Privacy Policy (the “Policy”) applies to the information Firmspace collects through www.firmspace.com, including the Firmspace Dashboard, as well as subdomains or mobile versions of these sites, and any other website on which we post this Privacy Policy (collectively, the “Site”), as well as other features, services and content on the Site (“Content”). We may refer to our Site and Content as our “Service”.

This Policy describes what information we collect when you visit our Service, how we (or our service providers or others on whose behalf the information is collected) may use, process, and share that information, your choices with regard to your information, and other related matters. This Policy is incorporated into our Terms of Service. Through your use of our Service, you consent to the practices described in this Policy. Terms not otherwise defined here will have the same definitions as set forth in our Terms of Service.

Except as otherwise expressly set forth below, this Policy is applicable only to information we collect through our Service. This Policy does not apply to any information that you provide offline, whether in person, over the phone, or otherwise. Similarly, this Policy does not apply to information collected by third parties, regardless whether you arrive at such third parties’ sites or services through our Service.

Information we collect and how we use it

We may collect personal and other information about you when you use our Service, as described below. “personal information” includes any information relating to an identifiable individual, whether alone or in combination with other information. We typically collect personal information and other data from you, and use that information in the following ways and as otherwise communicated to you from time to time (subject to your consent when required by applicable laws).

Inquiry Form and License Agreement. Users that complete an inquiry form on our Service must provide certain personal information in order for us to respond to your inquiry, and users who enter into a License Agreement must provide additional information in order to become a Member. We use this information to respond to your inquiry or to fulfill your License Agreement and grant you access to the Firmspace Dashboard. If you have inquired about our services or become a Member, we may add you to our email list and provide other information we believe would be of interest to you. In certain locations, we may require individuals to undergo a background check before approving them as a Member or Member Representative, which will likely require the submission of confidential personal information, such as your social security number, to a third party.

Payment Information. When you become a Member and make any payments through our Service, we ask you for personal information, including information about your payment card or bank account, in order to process and validate the payments. We do not keep this information or store it, rather it is processed and stored by the third party we use to process your payments to Firmspace, exclusively for this purpose.

When you sign up for our mailing list. When you sign up for our mailing list or request our newsletter, we will collect personal information such as your email address and any other information included on the sign up form. We will use this information in order to send you our newsletter or information about our services, as well as other promotional offers or information that we believe may interest you.

Usage Data. If you are a Member, we may track your usage of various features and functionality within the Firmspace Dashboard and elsewhere on our Service, and we may be able to associate such usage with your account. We may also collect analytics data from your use of our Service, such as: your IP address, browser type, domain names, access times, and referring web service addresses, which may be associated with your account if you are logged in as a Member, or may be anonymous if you are not registered or logged in to our Service. For all users of our Service, we may also log click-stream data, which typically includes information such as the page served, the time, the source and type of browser making the request, the most recent page view, and other non-personal information. We collect these types of data for purposes of system administration, to improve our Service, and for other internal uses related to the Service. This information also helps us analyze how visitors arrive at our Service, what type of Content is most popular, what type of visitors in the aggregate are interested in particular features or Content, and the like.

If you enter a contest, sweepstakes or other promotion. We may operate contests, sweepstakes or other promotions (each, a “Promotion”) through our Service, which may require registration on our Service or through our social media channels in order to enter. Your personal information may be used by us to contact you for winner notification, prize delivery confirmation or other promotional purposes. Your entry may also result in your being added to our marketing lists as well as those of third parties (sponsors or otherwise) associated with the Promotion. If you win a Promotion, your acceptance of a prize may require you (unless prohibited by law) to allow us to post publicly some of your personal information on our Service or elsewhere, such as on a winner’s page. In some instances, a third-party advertiser or sponsor may operate or host a Promotion on the Service together with Firmspace and collect your information. In cases where we are not the sponsor, operator or host of the Promotion, we may have no control over the information collected and accordingly encourage you to review the official rules of the Promotion as well as the advertiser’s or sponsor’s privacy policy applicable to the Promotion before participating.

Use of cookies and similar tracking technologies

Our Service may use cookies, web beacons, pixel tags, and similar digital tracking technologies. Cookies are small data files that are transferred to your hard drive when you visit a website if your browser settings permit the acceptance of cookies. Cookies may enable us to recognize your computer, keep you logged in to the Firmspace Dashboard, store your preferences and settings, enhance your user experience by delivering Content specific to your interests, perform searches and analytics and assist with security administrative functions. Similar technologies, such as web beacons or pixel tags, function through the use of small files, such as a GIF or PNG, which are opened on a page, ad, or in an email. The request for these files from a server reveals certain information, such as your browser type, IP address, and other information. Tracking pixels (sometimes referred to as web beacons or clear GIFs) are tiny electronic tags with a unique identifier embedded in websites, online ads and/or email, and that are designed to provide usage information such as ad impressions or clicks, measure popularity of the Service and associated advertising, and to access user cookies. We may also use these automated technologies to collect and analyze other non-personal information related to the devices you use to access the Service, such as IP addresses, browser types, browser language, unique device identifiers and other information about your computer(s) and/or mobile device(s). Some tracking technologies on our Service may be provided by a third party (which may be collecting information on its own behalf, or may be providing such information to us). Our Service may use cookies or other technologies provided by website analytics services to help us better understand how our Service is used. By tracking how and when you use our Service, these technologies help us determine which features and Content on our Service are most important to our visitors. Our Service may also use cookies or other technologies to provide advertising tailored to your individual interests. With whom we share your personal information

We may share your personal information with our current or future affiliated entities, subsidiaries, and parent companies. We may also share your personal information and other information with trusted third parties for marketing advertising, or other commercial purposes if we believe they may offer goods or services that may interest you. We may, without your consent, share personal information and other data with service providers who provide certain services on our behalf, or in the other circumstances noted below. For example, we may share personal information we collect with third parties such as providers of data hosting or processing services, email and postal mail providers, payment processors, or other parties which provide service on our behalf.

In extraordinary circumstances, we may, without your consent, share personal information when necessary or appropriate to comply with the law; cooperate with law enforcement or national security requirements; respond to lawful requests; protect the interests of Firmspace, our customers, property, or the public; or, to enforce our Terms of Service. Similarly, we reserve the right to share personal information with governmental authorities or otherwise in response to a legal request that we believe requires us to do so. We will share any such information to the extent we believe that request requires. Legal requests include, for example, search warrants, subpoenas, and other court orders. We may also receive legal requests or orders from jurisdictions outside the United States, in which case you consent for your personal information to be transferred to the applicable country. Finally, in the event we undergo a merger, sale, transfer or liquidation of our business or substantially all of our assets, any personal information we possess may be part of the assets sold or otherwise transferred, or may be reviewed during due diligence review in the course of a potential transaction.

Your Choices

It is possible for you to use our Service without providing any personal information, but you may not be able to access certain features or view certain Content. To the extent required by law, you may choose to opt out of sharing with third parties with whom we may share your personal information; however, you may be unable to use the Service or certain features if you wish to limit such sharing. Further, you may, to the extent you have consented to do so, opt out of having your information provided to third parties for marketing or other promotional purposes, and opt out of additional communications from us. To opt-out from marketing emails, simply unsubscribe from the email newsletters or similar communications by clicking on the unsubscribe link in the email.

Accessing, Correcting and Deleting Your Information

You may access or update any personal information we hold about you by clicking on the Preferences menu in the Firmspace Dashboard, or by sending an email to support@firmspace.com. We will respond to reasonable requests for access or revision and will provide access to the extent required or allowed by law. However we may decide not to grant access or make revisions where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in any given case, or when the rights of others would be violated by granting the access.

Accounts will be deactivated upon your request (or in some cases, deactivated or suspended, as described in our Terms of Use). Please note, following termination or closure of your account, we may retain information for a reasonable amount of time should you wish to reactivate your account, and we may retain certain information indefinitely if we believe that it is necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

To obtain a list of the personally-identifiable information that Firmspace holds about you, or for residents of California (as required by California law) any personal information Firmspace has disclosed about you to third parties for direct marketing purposes during the preceding calendar year (if any) please send a written, signed request to us at the mailing address listed below.

Finally, although we do not permit use of our Service by individuals under the age of 18, to the extent required by law, we permit minors under the age of 18 to request the deletion of any Content or information that the minor has posted or made publicly available through our Service (if any). To request that information you have made available on our Service be removed, please send a letter or email to the address below with (i) your name, (ii) a complete description of the Content you would like removed, and (iii) the web address(es) of the Content you would like removed. Please be aware that our fulfillment of this request does not ensure complete or comprehensive removal of the Content or information you have posted on our Service.

Information Security

We use reasonable security measures to protect your personal information. We implement and review various physical, procedural and technological safeguards that we believe will keep your personal information secure.

By using our Service, you consent to the terms of this Policy. We may change this Policy from time to time. We will post the effective date for this and any revised policy.
